  1. General.

    Welcome to the Carzac website (the “Site”) and application (the “App”, and together with the Site, the “Service”). Before downloading the Carzac mobile application (the “App”) or using the Carzac website (the “Site”), it is important that you carefully read and understand this Privacy Policy (“Privacy Policy”). This Privacy Policy describes how we collect and use information that you provide to us via the Service. Capitalized terms that are not defined in this Privacy Policy have the same meanings as are stated in our Terms of Service (the “Terms”).

    By accessing and using the Service (including providing information through the Service), you expressly consent to our collecting, using and disclosing your Personal Information (as defined below) in accordance with this Privacy Policy. The date at top of this privacy policy indicates the last date upon which the Privacy Policy was modified. We may modify this Privacy Policy at any time. In such event, we will post a notification of such change on the Site. The modified Privacy Policy will become effective no sooner than fourteen (14) days after the notification is posted within the Service, unless modifications are made for legal reasons or to describe new functionality, in which case the modifications will immediately be effective. We encourage you to visit the Privacy Policy from time to time to determine whether the Privacy Policy has been modified and whether any changes to the Privacy Policy made affect you. Your continued use of the Service after any such modifications have been made constitutes your acceptance of any and all such modifications. If you disagree with any modifications to the Privacy Policy, you should stop accessing and using the Service.

  2. Information Collection.
    1. General. When you use the Service, we collect information about you (“Personal Information”) using the following methods:
      1. First, whenever you provide information to us voluntarily using the Service, such as when you complete and submit a form located within the Service, or questions to us regarding the Service, we collect the information about you that you provide (e.g., your email address).
      2. Second, when you use the Site, in addition to any information you voluntarily provide to us, we may collect the following information fields from you based on your visiting the Site:
        1. Your IP address;
        2. The date and time of your visit;
        3. Your browser user agent string (information your web browser automatically sends to us so we can properly format the Site based on your device type and browser version);
        4. Any third-party websites that referred you to the Site; and
        5. Your language.
    2. App. We collect the following Personal Information when you use the App:
      1. Your name;
      2. Your email address;
      3. Your photo;
      4. Your approximate home, work and any other locations your provide to us.;
      5. If you are a driver, a photo of your vehicle, the number of seats available in your car, and your license plate number;
      6. Information regarding your commute preferences, such as:
        1. Days of the week when you tend to drive;
        2. Days of the week when you would like a ride;
        3. Time of commute departure;
        4. Time of commute return;
      7. Your telephone number;
      8. Your credit card or debit card information, as described in Section 4 below;
      9. The Third-Party User Data, as applicable and as described in Section 9(b) below;
      10. If you permit us access to your phone’s camera and photos, any photos you elect to transmit to us using the App.
    3. Cookies.The Site uses cookies, which contain information that helps us refine our Site based on user preferences, make certain features of the Site available to you and to help us track your use of the Site. By changing the options of your web browser, you can instruct it to accept all cookies, block certain cookies, require your permission before placing a cookie on your computer, or to block all cookies from being placed on your computer. However, please note that if you block cookies from the Site, you may not be able to use all of the functionality that is available on this Site.
    4. Email Addresses. If you provide your email address to us, we may send email to you at that address (for example, we may send you emails about your use of the Service). We may also provide that email address to our third-party vendors that help us with email correspondence, for the purpose of helping us send such email to you. If you click on a link in an email we send, we may elect to redirect you to a third-party vendor’s servers to register the link, and your clicking on the link may indicate to a third-party vendor and/or to us that you have clicked the link to visit the linked website.
  3. Information Use and Disclosure.
    1. When You Use the Service.
      1. General. In order for you to fully use the Service, we need to share certain parts of your Personal Information with other users. Specifically, we provide the following information to other users:
        1. Your first name and the first initial of your last name;
        2. Your photo either provided from linking your account to Facebook or LinkedIn or a photo you have provided directly to us;
        3. If you have signed up through Facebook, the number of friends you have on Facebook;
        4. If you have signed up through LinkedIn, your employment position;
        5. If a user has a route that is in close proximity to the meeting places you have selected or that user has picked the same meeting places as you have, that user will see the meeting places you have selected near your home, work or the other locations you’ve entered;
        6. If you are offering to drive, the days of the week when you tend to drive;
        7. If you are offering to drive, the time of commute departure;
        8. If you are offering to drive, the time of commute return;
        9. If you are a driver, a photo of your vehicle, and the number of available seats in your car; and upon establishment of a ride, the user riding with you would see your license plate number.
        10. If you have expressed days and times that you intend to ride or offer to drive others, those days and times; and
        11. Specific, predetermined messages that you designate to be sent to other users.
      2. Employer-Sponsored. If you have signed up for the Service as part of an employer-sponsored program, we may disclose information to your employer (including Personal Information) relating to your use of the Service.
    2. Other Uses. We use your Personal Information for the following purposes:
      1. To respond to your requests for information from us, our vendors, or affiliates;
      2. To improve the Site and the App, and the functionality of the Service;
      3. To provide you with information regarding the products and services we provide (including, for example, to email you about your activity using the App);
      4. To investigate and respond to allegations that the Site violates the rights of third parties (including without limitation, third parties’ intellectual property or other proprietary rights, rights of confidentiality, or rights of privacy);
      5. To investigate and take action to prevent or respond to any violations of the Terms, illegality, fraud, or to prevent
      6. To comply with applicable law, court orders, subpoenas, or other legal requirements, or to help Carzac and its affiliates exercise or establish its or their rights under the law, or defend themselves against legal claims;
      7. In connection with any sale, transfer, or sharing of our assets with a third party in connection with a sale of assets, reorganization, merger or acquisition event, or in the event of a bankruptcy. In addition to the foregoing, we may share information that does not specifically contain your Personal Information, but instead aggregated information (non-personally-identifiable information such as log data) with third parties for demographic profiling, industry analysis, and other purposes. We may engage the services of third parties to help us provide the Site and related functionality to you. Those third parties will have access to your Personal Information only to the extent needed to perform those activities on behalf of us, and are obligated not to use or disclose it for any other purpose.
  4. Credit Card and Debit Card Numbers. We use Stripe to help us process credit card and debit card numbers when you make payments to us. Stripe collects certain information about you when you provide your credit card or debit card number – please review Stripe’s privacy policy for information concerning Stripe’s collection, use and disclosure practices. As of December 1, 2014, Stripe’s privacy policy is available at https://stripe.com/us/privacy.
  5. How We Respond to “Do Not Track” Signals. Certain web browsers have “Do Not Track” or similar settings, which allow you to tell the websites you visit that you do not want your activities on such websites tracked. Currently, the Site does not respond to “Do Not Track” or similar settings, so your activities on the Site will be tracked regardless of your browser settings.
  6. Security of Transmissions. While we use certain methods to protect the information you provide to us from unauthorized access, use and disclosure, please know that communications over the Internet cannot be guaranteed to be absolutely secure, and we cannot guarantee the absolute confidentiality of any information you provide to us through the Service.
  7. Storage of Data. Please note that the Personal Information you provide in connection with the Site may be stored on computers that are located outside of the state/province, country, or other jurisdiction in which you reside; and that the laws in such places may not be as protective of the privacy of your Personal Information as the laws in your home jurisdiction. Your provision of information to us constitutes your agreement to our transferring, processing, and storing such Personal Information in such other jurisdictions.
  8. Personal Information Provided by Minors. The Site is intended for use by individuals who are at least eighteen (18) years of age. In accordance with the federal Children’s Online Privacy Protection Act of 1998 (COPPA), we do not knowingly collect personal information about individuals who are younger than thirteen (13) years of age (“Minor Personal Information”). If you become aware that we are in possession of Minor Personal Information belonging to your child, please notify us immediately in writing at the addresses below, and we will delete such from our records.
  9. Third-Party Sites and Services.
    1. Third-Party Websites.The Service may contain links to other websites, and other websites may provide links to the Service. Please note that we do not control these third-party sites and that we assume no liability or responsibility for them, including any content or services provided to you by such. Please review the terms of service and privacy policies of each such third-party website you visit, as the Terms and this Privacy Policy will not apply to such websites. YOU ARE SOLELY RESPONSIBLE FOR YOUR USE OF THIRD-PARTY WEBSITES, AND SUCH USE IS AT YOUR SOLE RISK. CARZAC DOES NOT ENDORSE, SPONSOR OR RECOMMEND, AND IS NOT RESPONSIBLE FOR ANY PRODUCTS, SERVICES, CONTENT OR INFORMATION AVAILABLE ON THIRD-PARTY WEBSITES.
    2. Facebook Connect and Sign In With LinkedIn. For your convenience, we allow you to use the Facebook Connect and LinkedIn functionality to log into our App using your Facebook, Inc. (“Facebook”) or LinkedIn Corporation (“LinkedIn”) login credentials. If you elect to log in via this method, you acknowledge and agree that (i) certain information regarding your use of the App may be available to Facebook or LinkedIn (as the case may be), and that (ii) any and all information that you agreed that Facebook or LinkedIn could provide to us through its Application Programming Interface (API) (“Third-Party User Data”), such as your first and last name, email address, user name or other identifier or access token, number of friends, your photo, and your employer name, may be collected, used, and stored by us in accordance with this Privacy Policy. You may choose not to use Facebook Connect or Sign In With LinkedIn to log in, and may instead use your name and email address. For clarity, your use of Facebook’s and LinkedIn’s websites and other offerings, and your Third-Party Account Information, is and continues to be governed by the terms of service and privacy policy of Facebook and LinkedIn, respectively.
    3. Analytics Services. The Service uses analytics services, which compile and report to us information about users’ IP addresses and their use of the Service (the “Analytics Information”). We engage third-party providers (“Analytics Providers”), which in turn place cookies and use other technologies on your computer to collect data and provide Analytics Information to us. These Analytics Providers use and distribute the Analytics Information they collect in accordance with their respective privacy policies and terms of use (which use and distribution may include providing the Analytics Information to third parties as required by law or as needed to provide the analytics services to us). At present, our Analytics Provider is Mixpanel; its privacy policy is located at http://mixpanel.com/privacy and its terms of use are located at http://mixpanel.com/terms.
